The EB-1C Visa facilitates the transfer of international executives or managers to U.S.-based companies. Unlike temporary visas like the L-1, the EB-1C provides a pathway to permanent residency (Green Card).

 

Eligibility Criteria

  1. Position Requirements
    • Applicant must have worked as a manager or executive outside the U.S. for at least one year in the past three years.
    • The position in the U.S. must also qualify as managerial or executive and be full-time.
  2. Company Relationship
    The U.S. employer and the foreign company must have a qualifying relationship:
    • Parent company, subsidiary, affiliate, or branch office.
    • Both entities must be actively operational.
  3. Company Operations in the U.S.
    • The U.S.-based company must have been operational for at least one year before filing the petition.
  4. Employment History
    • The employment outside the U.S. must be with the same employer, parent company, or a subsidiary/affiliate.

 

Process for EB-1C Visa

  1. Employer Petition
    The U.S. employer files Form I-140 with USCIS on behalf of the employee. The petition must demonstrate:
    • The qualifying relationship between the U.S. and foreign entities.
    • The applicant’s eligibility as an executive/manager.
  2. Evidence Required
    • Proof of employment history (letters from employer, contracts).
    • Organizational charts showing managerial or executive role.
    • Financial documents showing both entities are actively operational.
  3. Adjustment of Status or Consular Processing
    • If the applicant is already in the U.S., they can file Form I-485 to adjust status to permanent resident.
    • If outside the U.S., the process continues at a U.S. consulate.
